These Terms of Service (“Terms”) govern your use of the Peopleology website and any consulting, recruitment or speaking services provided by us. By using our website or engaging our services, you agree to these Terms.
Effective 28 August 2025
The Peopleology website (“Site”) is operated by Peopleology (ABN 92 397 706 507) (“Peopleology”, “we”, “us”, “our”). We are a real estate business consultancy and recruitment firm based in Victoria, Australia.
These Terms should be read alongside our Privacy Policy, which forms part of your agreement with us.
By accessing this Site, completing a form, or otherwise engaging Peopleology, you confirm that you: (a) are at least 18 years of age; (b) have the legal capacity to enter into a binding agreement; and (c) accept these Terms in full.
If you are using the Site or engaging our services on behalf of a business, you warrant that you have authority to bind that business to these Terms.
Peopleology offers real estate business consulting, recruitment and executive search, remuneration benchmarking, culture and growth advisory, speaking and workshops. The specific services, scope, deliverables and fees for any engagement will be set out in a separate written proposal or engagement letter, which will prevail over these Terms in the event of any inconsistency.
All fees are quoted in Australian dollars and are exclusive of GST unless stated otherwise. For recruitment engagements, an engagement fee is payable to commence the search and a placement fee is payable on successful hire, as set out on our Recruitment page and in your engagement letter.
Invoices are payable within 14 days of issue unless otherwise agreed in writing. Amounts unpaid after the due date may attract interest at the Reserve Bank of Australia cash rate + 2%, calculated daily. We may suspend or terminate services for material non-payment.
For permanent placements, we offer a 90-day replacement guarantee: if a candidate placed by us leaves or is terminated for cause within 90 days of their start date, we will conduct a replacement search at no additional placement fee. Reasonable expenses (advertising, background checks) are payable by the client. The guarantee does not apply where the departure is caused by material misrepresentation by the client, redundancy, or changes to the role or terms of employment after commencement.
You agree to:
If you register with Peopleology as a candidate, you warrant that: (a) all information you provide is true and current; (b) you have the legal right to work in Australia (or the location where the role is offered); (c) you are not subject to any restraint that would prevent you from taking on a new role; and (d) you consent to us providing your information to prospective employers with your prior approval.
All content on this Site — including text, graphics, logos, images and design — is owned by or licensed to Peopleology and protected by Australian and international copyright, trademark and other laws. You may view and download content for your own personal, non-commercial use only. Any other use requires our prior written consent.
Reports, frameworks, playbooks or written materials produced during an engagement remain the intellectual property of Peopleology unless expressly assigned in writing. You are granted a perpetual, non-transferable licence to use those materials for the internal purposes of your business.
Each party must keep confidential all non-public information disclosed by the other party during an engagement, and only use that information for the purpose of performing under these Terms. This obligation continues indefinitely after the engagement ends, except where information is legally required to be disclosed, or is or becomes public through no fault of the receiving party.
The Site may link to third-party websites or services (for example LinkedIn). We do not control those sites and are not responsible for their content, privacy practices, or availability. Your use of any third-party site is governed by that third party’s own terms.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law. Where our liability for a breach of a non-excludable guarantee can be limited, our liability is limited (at our option) to: (a) supplying the services again; or (b) paying the cost of having the services supplied again.
We will provide our services with due care and skill and in accordance with recognised professional standards. Beyond that, the Site and our services are provided “as is” and “as available”. To the maximum extent permitted by law, we exclude all other warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
Recruitment involves human judgement. While we screen and reference-check every candidate, we do not warrant that any candidate will be successful in a role or a cultural fit. Final hiring decisions are the client’s responsibility.
To the maximum extent permitted by law, our total aggregate liability to you — whether in contract, tort (including negligence), under statute or otherwise — arising from or in connection with these Terms or any engagement is limited to the fees paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim.
Neither party is liable for any indirect, incidental, consequential or special damages, or loss of profits, revenue, data, goodwill or business opportunity, howsoever arising.
You agree to indemnify and hold Peopleology harmless from any losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your provision of false or misleading information to us.
Either party may terminate an engagement in writing where the other party is in material breach and has failed to remedy that breach within 14 days of receiving written notice. Fees accrued up to the date of termination remain payable. Sections that by their nature should survive termination (including confidentiality, IP and liability) will survive.
Neither party is liable for any delay or failure to perform caused by events beyond that party’s reasonable control, including natural disaster, pandemic, industrial action, cyber attack or government action. The affected party must give prompt written notice and use reasonable endeavours to work around the event.
These Terms are governed by the laws of Victoria, Australia. Each party submits to the exclusive jurisdiction of the courts of Victoria and any court entitled to hear appeals from them.
We may update these Terms from time to time. The current version, and the effective date, will always be published on this page. Continued use of the Site or our services after changes are posted constitutes acceptance of the updated Terms.
